Streamlining Food Imports and Exports in Argentina

The Argentine government has recently introduced significant changes to enhance and simplify the sanitary processes associated with the import and export of food products. On January 20, 2025, Decree 35/2025 was issued, amending the long-standing Decree No. 2126/1971, which governs Law 18.284 and the Argentine Food Code. This amendment marks a pivotal shift in how Argentina approaches its food trade regulations, aligning with modern global standards and fostering greater efficiency.

A New Approach to Imports

One of the most notable updates involves a streamlined process for importing food products, packaging, and materials that come into contact with food. Under the new decree, products certified by countries with high sanitary standards, or those with economic integration treaties or reciprocity agreements with Argentina, can now be imported using a Sworn Declaration of Import. This eliminates the need for lengthy bureaucratic approvals, provided that the products have:

  • A marketing authorization or a free sale certificate from the country of origin.
  • Approval from the competent health authority in the country of origin.

This is a progressive step that recognizes the equivalence of international standards and reduces barriers for businesses aiming to bring high-quality food products into Argentina.

Simplifying Exports

For Argentine exporters, the process has also been streamlined. Exported products now only need to meet the specific requirements and restrictions of the destination country. When required by the importing nation, exporters can obtain the necessary sanitary certificates through the National Food Institute (INAL). This targeted approach allows Argentine businesses to navigate international markets with greater ease and responsiveness.

Preparing for Implementation

The National Administration of Drugs, Foods, and Medical Devices (ANMAT) has announced that additional provisions and procedures will soon be published to ensure the smooth implementation of these changes.
